Naseema Akthar secures acquittal for a client accused of Assaulting a Police Officer

Solicitor Naseema Akthar secures acquittal for a client accused of Assaulting a Police Officer. In this instance, Naseema used excellent Trial strategy and Advocacy which resulted in the Prosecution failing to prove its case beyond a reasonable doubt.

The cornerstone of our Criminal Justice System is the notion that you are innocent until proven guilty. In order to have secured a conviction for the offence, the Prosecution were obliged to satisfy the requisite standard of proof beyond a reasonable doubt. In other words, the Magistrates had to be sure that every element of the offence could be proved by the Prosecution. In this case, oral testimony was given by the Police and the Defendant. After a short deliberation, the Magistrates returned a not guilty verdict. The Defendant was exonerated having repeatedly remonstrated her innocence from the outset.

Naseema commented- “I left no stone unturned when preparing this case which was the key factor in securing the acquittal. This case was fraught with difficulties and during the evidence, there was a catalogue of inconsistencies which ultimately led to the acquittal. The strength and the sufficiency of the evidence fell below the required burden and standard of proof in a criminal case”.
