Drunk in Charge
If convicted of this offence you do not have to be disqualified from driving. It is possible, unlike with drink driving, for you to have your licence endorsed with points instead of a ban. This charge is more complex that drink driving as the definition of “in charge” is open to interpretation and the law in this area contains a built in (statutory) defence. If you are able to argue that you were not intending to drive the car until your alcohol level had fallen below the legal limit, you have a defence to this.
