Causing Death Or Serious Injury By Dangerous Driving
If you are charged with this offence it means that the prosecution believe that you are responsible for “causing the death (or serious injury) of another by driving a mechanically propelled vehicle dangerously on a road or other public place”. Dangerous driving means that the prosecution must prove that the standard of that driving fell far below that of a careful and competent driver. The prosecution will also have to prove that it was that driving which caused the death or serious injury, or another person. You do not have to prove that it did not. This offence carries up to 14 years in prison, a minimum 2 year ban and a mandatory extended re test.
