Causing Death By Careless Driving
If you are charged with this offence it means that the prosecution believe, and must prove beyond doubt, that your standard of driving fell below that of a careful and competent driver and that your actions in doing so caused the death of another person. These are always difficult and sensitive cases for all concerned as a mere momentary lapse in concentration whilst driving, glancing down at your phone for example, may be enough for a conviction. The offence carries up to 5 years in prison and a mandatory ban.
